Chatseeker Terms of Service

1. Agreement and Scope

These Terms of Service ("Terms") govern access to and use of the Chatseeker platform ("Service").

The Service is provided exclusively to business customers (B2B). By using the Service, you confirm that you act in a commercial or professional capacity.

These Terms form the entire agreement between the Customer and Chatseeker.

2. Definitions

  • Service – Chatseeker software platform
  • Customer – business user of the Service
  • Account – registered account
  • Customer Data – all data processed via the Service
  • End Users – third-party users (e.g., fans)
  • Credits – prepaid service units (not money)

3. Nature of the Service

Chatseeker provides a technical CRM and workflow infrastructure.

  • does NOT operate creator accounts
  • does NOT act as an agency
  • does NOT independently communicate with end users
  • does NOT control or supervise user behavior

The Service is strictly a tool enabling Customer-configured workflows.

4. Eligibility (B2B Only)

The Service is strictly intended for businesses.

By using the Service, you represent that you are acting in a commercial capacity and that you are not a consumer.

5. Account Responsibility

The Customer is solely responsible for:

  • all activities conducted through the Service
  • all communications initiated via the Service
  • all team members and granted access
  • account security

6. Customer Responsibility

The Customer is fully responsible for:

  • all outputs generated via the Service
  • all data processed
  • all integrations with third-party platforms

All outputs are deemed to be initiated and controlled by the Customer.

7. Prohibited Use

The Customer agrees NOT to:

  • violate applicable laws
  • violate third-party platform rules, including but not limited to Fansly
  • engage in deceptive or misleading conduct
  • impersonate individuals unlawfully
  • process personal data without legal basis

8. No Scraping / No Unauthorized Automation

The Customer agrees:

  • NOT to use the Service for scraping or data extraction in violation of platform rules
  • NOT to bypass technical protections
  • NOT to deploy automation in violation of laws or platform terms

Chatseeker does not endorse such activities and is not responsible for consequences.

9. Automation Disclaimer

The Service may allow automated workflows.

However:

  • automation is configured and activated by the Customer
  • Chatseeker does not initiate actions independently
  • Chatseeker does not determine content or recipients

The Customer is fully responsible for all automated actions.

10. No Communication Role

Chatseeker is not:

  • a sender of messages
  • a communication provider
  • a representative

All communications are attributable to the Customer.

11. AI-Assisted Chat, Fan Eligibility, and Conversation Prioritization

Where enabled by the Customer, the Service may support AI-assisted messaging, fan routing, prioritization, filtering, risk detection, and automated workflow rules. Chatseeker does not guarantee that every End User will receive a response, be engaged in conversation, or remain eligible for AI-assisted interaction.

Chatseeker does not guarantee that AI-assisted chat will generate revenue, conversions, purchases, tips, renewals, engagement, or any particular business result. AI-assisted chat outputs may be incomplete, inaccurate, unsuitable, delayed, unavailable, or restricted, and the Customer is responsible for reviewing and supervising use of the feature.

The Service may allow workflows to pause, suppress, block, deprioritize, or decline conversations based on Customer-configured rules, platform requirements, safety signals, age eligibility, fraud or abuse indicators, consent or account status, engagement patterns, payment-intent signals, operational capacity, or other lawful and commercially relevant criteria.

If the Service detects or receives information indicating that an End User may be underage, legally ineligible, unsafe, abusive, fraudulent, or otherwise unsuitable for interaction, AI-assisted chat functionality may be restricted or unavailable for that End User.

AI-assisted chat is not intended to negotiate, accept, or confirm custom content requests, custom service arrangements, in-person meetings, off-platform communications, off-platform payments, or migration of conversations to other platforms. The Customer must not configure or use the Service to create such arrangements through AI-assisted workflows.

The Customer remains solely responsible for configuring, reviewing, and supervising AI-assisted workflows and for ensuring that all use of such workflows complies with applicable law, platform rules, consent requirements, age restrictions, and the Customer's own obligations.

12. Third-Party Platforms

The Service may interact with third-party platforms, including but not limited to Fansly.

Chatseeker:

  • is not affiliated
  • does not guarantee compliance
  • is not responsible for bans or restrictions

13. Service Credits

The Service may use prepaid credits.

Credits:

  • are not money or e-money
  • cannot be withdrawn
  • are non-transferable
  • are non-refundable except where required by law

14. Payments

Payments are processed via third-party providers.

Chatseeker offers two subscription plans per creator account:

  • Lite: USD 9 per creator account per billing cycle, plus a 15% commission on commissionable revenue
  • Pro: USD 69 per creator account per billing cycle, plus a 10% commission on commissionable revenue
  • both plans include the same Service features, and no features are withheld based on whether the Customer uses Lite or Pro
  • the commercial difference between Lite and Pro is the applicable commission rate
  • Chatseeker does not store sensitive payment data

All fees are charged in advance and exclude taxes. Refund eligibility is governed by the Payment and Refund Policy, including the 48-hour refund window and AI-cost limitation described there.

15. No Free Trial, Plan Changes, and Commission

Chatseeker does not provide a free trial.

Customers may choose between Lite and Pro when purchasing the Service.

Plan changes cannot take effect during the current month or active billing cycle. Any switch between Lite and Pro applies from the next billing cycle.

Commissionable revenue means tracked revenue from paid messages, tips, and other chat-generated content processed through the Service.

Chatseeker does not charge commission on subscription revenue.

16. Data Protection

Customer = Data Controller

Chatseeker = Data Processor

The Customer is responsible for:

  • lawful data collection
  • consent
  • GDPR compliance

17. Sensitive Data

Customer acknowledges that data may include sensitive personal data.

The Customer is fully responsible for lawful processing.

18. Content Ownership and Rights

Customer retains ownership of all content.

Customer grants Chatseeker a license to:

  • process
  • store
  • transmit

data solely for service provision. Customer guarantees rights to use such content.

19. Technical Support and Account Access

Chatseeker may provide support.

Customer authorizes Chatseeker to:

  • access account data
  • perform diagnostics

No guarantees for support availability or response time.

20. Disclaimer of Warranties

Service is provided "AS IS" and "AS AVAILABLE".

To the maximum extent permitted by applicable law, Chatseeker disclaims warranties, representations, and conditions of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, accuracy, or fitness of results.

21. Limitation of Liability

To the maximum extent permitted by law, Chatseeker is not liable for:

  • indirect damages
  • loss of profits or data
  • account suspensions, restrictions, bans, or platform enforcement actions
  • automation-related issues
  • AI-assisted chat outputs, missed replies, declined conversations, or unavailable AI-assisted interactions
  • data processing violations

Total liability is limited to fees paid in the last 30 days.

22. Indemnification

Customer agrees to indemnify Chatseeker against claims arising from:

  • misuse of the Service
  • violation of laws
  • platform violations
  • automation and communication

23. Suspension and Termination

Chatseeker may suspend or terminate access if:

  • Terms are violated
  • payment fails
  • risks are detected

Customer may terminate at any time.

24. Compliance and Cooperation

Customer agrees to cooperate in case of legal inquiries or regulatory investigations.

Failure to cooperate may result in suspension.

25. Abuse Prevention and Monitoring

Chatseeker may monitor usage to detect:

  • abuse
  • suspicious activity

Accounts may be restricted or suspended.

26. Beta Features

Beta features may be:

  • unstable
  • incomplete

Beta features are provided for evaluation purposes and may be modified, suspended, or withdrawn at any time without liability.

27. Data Retention and Deletion

Data may be retained temporarily after termination.

Customer must export data before termination.

Chatseeker is not liable for data loss.

28. Service Providers and Affiliates

Chatseeker may engage affiliates and third-party service providers as reasonably necessary to operate, secure, support, and improve the Services.

Where such providers process data or perform regulated functions on Chatseeker's behalf, Chatseeker will require appropriate contractual and legal safeguards consistent with applicable law.

29. International Use

The Services are offered using infrastructure and server systems located in the United States.

Customer must comply with international laws.

Service may not be suitable in all jurisdictions.

30. Copyright Complaints

We respect intellectual property rights. If you believe that material made available through the Services infringes your copyright, please send a notice to manuel@kollus.io including the following information:

  • your contact details
  • identification of the copyrighted work claimed to have been infringed
  • identification of the allegedly infringing material and its location within the Services
  • a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law

Knowingly false, misleading, or bad-faith notices may result in Account suspension or termination. Chatseeker may also suspend or terminate Accounts of repeat infringers.

31. Assignment

Chatseeker may transfer this Agreement.

32. Governing Law

Polish law applies.

Jurisdiction: Poland.

33. Updates

Terms may be updated at any time.

Continued use of the Service constitutes acceptance of the updated Terms.
